Got something to ask and share with u guys .. I was thinking something after my 2nd lecture last Thursday. About the Pre-order online shopping. But first, let me give you guys some introduction ...
For my final semester, I had registered for Islamic Banking & Finance subject, which I think, will give me more or at least some ideas what is Islamic banking system and how does it runs in Malaysia. As we know nowadays, banking system in Malaysia and even the whole world starting to switch from conventional banking system to Islamic banking system, not all, but ya we can see the changes in Malaysia now. Summore, people now starts to invest in dinar a.k.a gold rather than normal investment, because we all know that the value of gold will never decrease as it will always increase day by day.. But still, for me, there will be pros and cons if we take gold as our currency. We'll discuss about gold etc in the next next next entry (coz I dont know much bout that goldie2 thing as for now. aha!) and back to the subject, I think this is my opportunity to gain some knowledge about the system by taking the subject. If I let myself study on my own bout this thing, of course it will never works due to my laziness! Therefore, I need something to force myself to learn! huhuh ...
Okay lets move on to the details of the subject. In my 2nd lecture, which was held on last Thursday, Dr. Radiah taught us about the Rukun and Syarat in Islamic transaction. Plus, what is the unlawful transaction in Muamalat etc. Now, let me explain the basic of Rukun and Syarat that we need, before we do the "jual beli" transaction. First we must clarify what is RUKUN of trading:
Parties:
☛ Who is the seller and buyer.
Object:
☛ What are you selling or buying? Who's the owner of the object at the time of contract.
☛ Must have precise info about the object i.e price, quality and quantity etc. (the true condition of the object)
☛ Goods/services.
Offer/Acceptance (Agreement):
☛ Once the info has been clarified, thus both of the parties agree to all the conditions, therefore, the transaction is valid and lawful.
Once the Rukun has been fulfilled, the transaction is valid ( or otherwise).
I would prefer not to explain about the Syarat because, my intention of writing this entry is because, I was confuse about one thing, Pre-Order Basis Online Shopping.
As we all know, especially you girls out there, pre-order basis can be somewhat that the object is not in the seller's hand, for example like Korean Style. I bet, those who are doing on9 business, would know about this. The supplier is on9 supplier, the seller also on9 seller, and of course, the buyer is also on9 buyer. These 3 parties never met in reality as they were all online people. So, all these 3 parties do not know what is the condition of the goods (except for the supplier as the were doing this business online and they have the items on their hand), and yes, we do know about the PRICE, COLOR, QUANTITY but not the QUALITY!
Based on my experience (I had bought some of the stuffs several times before), what I see in the picture (on website/ Facebook), is different and sometimes it's TOTALLY DIFFERENT from what i had received! When I asked the seller, how is the color, material etc before i agree to buy, they do not know how to answer it and if they got to answer me, the answer was not met my satisfaction. So, in this case, there is an asymmetric information in the transaction. So my question is, should it be valid or not? Please advice somebody.
Thank you.
foot note: Will forward this to my lecturer and hope will get the answer. Once I get the answer, I will share it with you guys ya. Stay tuned people! :)
